Terms of Service Policy
All Payments To HollyRidge Computer & Web Services Are Non-Refundable HollyRidge Computer & Web Services agrees to furnish services to the Subscriber, subject to the following TOS (Terms of Service).
Use of HollyRidge Computer & Web Services Service constitutes acceptance and agreement to HollyRidge Computer & Web Services’ Acceptable Use Policy (AUP) as well as HollyRidge Computer & Web Services’ Terms of Service (TOS) and HollyRidge Computer & Web Services’ Privacy Policy.
All provisions of this contract are subject to the TOS (Terms of Service) of HollyRidge Computer & Web Services and AUP (Acceptable Use Policy). The AUP may be changed from time to time at the discretion of the Company. Subscriber understands that change to the AUP by the Company shall not be grounds for early contract termination or non-payment.
This Agreement shall be construed in all respects in accordance with the laws of the State of North Carolina, County of Wake applicable to contracts enforceable in that state. Venue will be Wake County, North Carolina
Disclosure to Law Enforcement: The AUP specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition HollyRidge Computer & Web Services shall have the right to terminate all service set forth in this Agreement.
Service Rates:Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that the Company may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon Company achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.
Payment:All payments are due prior to services rendered. On monthly plans, such as but not limited to Hosting or Management Type Plans, are due on or before the Monthly anniversary date. Upon failure to meet payment deadline, HollyRidge Computer & Web Services reserves the right to terminate all services on the user’s account, or may turn the account over to an outside collection agency for collection where you agree to pay an outside fee to retrieve your account. On any account that becomes 5 days past due are subject to a late fee. Any account over 30 days past due will be charged a late fee per month. Any account that has interrupted services due to failure to make payment is subject to a reinstatement fee prior to having their services returned. If the account is 90 or more past due then we reserve the right to turn it over for collections and/or to persue other methods of aquiring payment which the subscriber assumes responsibility for all fees and expenses ensued such as but not limited to collection fees, attorney fees, court cost, etc.
Special Fees
- Late Fee: 10% ($10.00 minimum)
- Reinstatement Fee: $20.00 (per server)
- Check Non Sufficient Funds Fee: $50.00 (per instance)
- Declined Credit Card Fee: $5.00 (per instance)
- Charge Back Fee: $50.00 (per instance)
- Order Cancellation Fee: 10% of order
Refund and Disputes: All payments to HollyRidge Computer & Web Services are nonrefundable. This includes any setup, monthly, and install fees reguardless of time used. Time allotments on monthly packages do not carry over from month to month. Any unused time will be forfeited on the anniversary date. Any overcharges or billing disputes must be reported in writing within 60 days of the date the disputed occurred. At no time will we refund anymore than fees paid or invoices generated. If you dispute a charge to your credit card issuer that, in HollyRidge Computer & Web Services’ sole discretion is a valid charge under the provisions of the TOS and/or AUP, you agree to pay HollyRidge Computer & Web Services an “Administrative Fee” of not less than $50 and not more than $100 per disputed charge.
Failure to Pay: We may temporarily deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and any collection, attorney, and court fees.
Account Cancellation: All requests for canceling accounts must be made in writting and sent through our help desk at least five (5) days prior to the day of cancelation. You must provide us with your account details for us to cancel your services for security purposes.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company’s liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
Transfer/Register of Domains: All new web hosting accounts involving new domains/transfers will be set up and entered into our DNS servers within 3 to 5 business days. Due to the unpredictable nature of the transfer process, no guarantees are made regarding the amount of time a specific transfer may take. If the new domain is registered by the account holder, there will be no handling fee. However, you may have HollyRidge Computer & Web Services register a domain name for you, registered under HollyRidge Computer & Web Services for the current fee per year. If the customer cancels service during the domain subscription period for any reason, all charges are considered earned. The domain registration fee is subject to change.
Support Boundaries: HollyRidge Computer & Web Services, provides technical support to our subscribers. The following is our guidelines when providing support: HollyRidge Computer & Web Services provides support related to your accounts physical functioning. HollyRidge Computer & Web Services does not offer tech support for application specific issues such as cgi programming, html or any other such issue. Support is handled through the online help desk for all online services. Non-online services, such as computer repair, may use online help desk, phone, or other methods.
Suspension of Service or Cancellation: We reserve the right to suspend our services to any customer if in the judgment of our administrators if the subscriber is in violation of any of the terms of our policies or for any other reason which are deemed necessary at our sole discretion. If inappropriate activity is detected, all accounts of the subscriber in question will be deactivated until an investigation is complete. Prior notification to the subscriber is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the subscriber’s machines were suspended nor in the case services are canceled the subscriber will not receive any sort of refund or restitution in whole or in part.
Indemnification
We wish to emphasize that in agreeing to our policies, customer indemnifies us for any violation of our policies that results in loss to us or the bringing of any claim against us by any third-party. This means that if we are sued because of a subscriber\’s or a customer of a subscriber’s activity, the subscriber will pay any damages awarded against us, plus all costs and attorney’s fees.
SPAM and Unsolicited Commercial Email (UCE): HollyRidge Computer & Web Services takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Accounts caught sending unsolicited, as defined HollyRidge Computer & Web Services* email/usenet postings, either through our servers or to promote a web site on our servers or to promote an affiliate link, will be terminated immediately, will not qualify for a refund and will be charged $50 per complaint filed.
*Unsolicited is defined, by HollyRidge Computer & Web Services as: E-mail sent to recipients who have not asked to be contacted by you or Usenet postings (that are cross-posted to more than three newsgroups and/or posted in newsgroups where this is against that groups FAQ or charter), for the sole purpose of promoting a website or commercial business on our servers.
System and Network Security: Users are prohibited from violating or attempting to violate the security of the HollyRidge Computer & Web Services Network. Violations of system or network security may result in civil or criminal liability. HollyRidge Computer & Web Services will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
- Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.
- Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
- Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, “flooding”, “mail bombing” or “crashing”.
- Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
- Taking any action in order to obtain services to which such User is not entitled.
Notification of Violation:
- HollyRidge Computer & Web Services is under no duty to look at each customer’s or user’s activities to determine if a violation of the AUP or TOS has occurred, nor do we assume any responsibility through our AUP or TOS to monitor or police Internet-related activities.
- First violation: Any User, which HollyRidge Computer & Web Services determines to have violated any element of this Acceptable Use Policy or Terms of Service, shall receive an email, warning them of the violation. The service may be subject at HollyRidge Computer & Web Services’ discretion to a temporary suspension pending a User’s agreement in writing, to refrain from any further violations.
- Second Violation: Users that HollyRidge Computer & Web Services determines to have committed a second violation of any element of this Acceptable Use Policy or Terms of Service shall be subject to immediate suspension or termination of service without further notice.
Changes to Our Policies
HollyRidge Computer & Web Services reserves the right to amend its policies at any time. All sites on HollyRidge Computer & Web Services must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate Cancellation.
Responsibility for Content: You, as HollyRidge Computer & Web Services’ customer, are solely responsible for the your content stored on and served by our HollyRidge Computer & Web Services’ server.
Miscellaneous Provisions
- You must provide us with, and keep current, good contact information for you such as e-mail, fax (if used), and telephone contacts.
- A waiver by us of any breach of any provision of this Agreement by Subscriber shall not operate as or be construed as a continuing or subsequent waiver thereof or as a waiver of any breach of any other provision thereof.
- Subscriber shall not transfer or assign this Agreement without our prior written consent. We may assign Agreement at anytime without consent from or notice to Subscriber. We reserve right to cancel subscriber’s rights under this contract at anytime without further obligation.
- We are not responsible for the content of any other websites linked to our network. Links are provided as internet navigation tools only. We disclaim any responsibility for any such inappropriate use and any liability to any person or party for any other person or party\’s violation of this policy.
- We are not responsible for any damages your business may suffer. We do not make implied or written warranties for any of our services. We deny any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by us.
- You will be held responsible for the actions of your clients and/or customers in the matter described on these terms and conditions. Therefore, it is in your best interest to implement a similar or stricter terms and conditions or otherwise called acceptable terms of use policy.
Acceptable Use Policy
HollyRidge Computer & Web Services provides web hosting and other services to many clients therefore we have a responsibility to protect each client and to provide the best services available. We believe these are fair and any normal site should have no problems following them. The following guidelines were established to ensure these obligations are met. We haven’t randomly thought of these rules, they are rules that have been put in place from experience as server administrators which we know make our servers perform better. If you have a question about them please contact us through our web site.
Content:
All services provided by HollyRidge Computer & Web Services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State, County, or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless HollyRidge Computer & Web Services and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.
HollyRidge Computer & Web Services will be the sole arbiter as to what constitutes a violation of this provision.
All Accounts Must Obey The Following:
The Following Scripts Are Banned from our hosting servers:
– Bot Programs
– Chat Programs unless authorized by HollyRidge Computer & Web Services
– Any Background Running Program unless authorized by HollyRidge Computer & Web Services
– IRC Programs
– Topsites scripts
– Streaming Media – Scripts VERY likely to eat up all of our CPU or RAM
If you are using a script to such an extent that you are causing negative impact to others on the server, we can briefly suspend your account while we work with the site owner to sort out the problems (script changes etc) and we have the right to leave said account suspended in the event (before, during, or after all forms of contact have been attempted) we cannot contact the owner of the account until the owner responds. We will always work with the site owner to locate the problem scripts and help to stop the problems happening again.
Download Sites:
This is any site where 20% or more of their monthly traffic is from file downloads.
– Sites using more than 20% of their resources for media unless authorized by HollyRidge Computer & Web Services.
– Sites hosting audio/video files of any kind unless authorized by HollyRidge Computer & Web Services.
– Sites hosting files over 5 megabytes in size each unless authorized by HollyRidge Computer & Web Services.
This is to prevent warez type content on our servers as well as to prevent excessive load and abuse of our bandwidth. However we may allow download sites with prior consent. Any site deemed to be a download site without prior authorization may be deactivated or terminated at our sole discretion.
HollyRidge Computer & Web Services will be the sole arbiter as to what constitutes a violation of this provision.
Backups:
The user agrees that they will keep backups of their sites on their computers. HollyRidge Computer & Web Services accepts no responsibility for loss of data, however HollyRidge Computer & Web Services does make every effort to make periodic backups of sites. This is an extra service and the end user is responsible for making sure they have up to date site files saved offline. If we have to locate files from our backups that users have accidentally deleted we may charge an administrative service fee per retrieval.
Commercial Advertising – Email:
Spamming, or the sending of unsolicited email, from a Site or using an email address or domain that is maintained on a HollyRidge Computer & Web Services machine as a reference is STRICTLY prohibited. Accounts in violation of our spamming policy WILL BE DELETED WITHOUT NOTICE. HollyRidge Computer & Web Services will be the sole arbiter as to what constitutes a violation of this provision. All mailing lists should be double opt-in. This means when users on a cliemts site give said client their e-mail address they user should also have to verify it through e-mail afterwards before anymore mail is sent. This prevents us being listed in spam databases. Any solicitation email(s) and/or newsletter(s) sent must have a valid link at the bottom for the reciever to opt-out of any future email(s) and newsletter(s). If they so choose to opt-out you must comply with their request within 24 hours and remove them from any future mailings. Failure to do so may cause your service to be deactivated or suspended.
HollyRidge Computer & Web Services will be the sole arbiter as to what constitutes a violation of this provision.
Chat Rooms:
We usually do not allow clients to install their own chat rooms. These tend to be a large drain on system resources and we cannot allow it as an account option. All types of chat rooms are normally prohibited, however should you require a chat room, you must first obtain our prior consent, and it must be approved by HollyRidge Computer & Web Services.
Background Running Programs:
We generally do not allow user programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed. These processes can include cron jobs and will be setup as we receive a helpdesk ticket to do so. No cron jobs will be setup that could affect any other site of the server.
IRC:
We currently do not allow IRC or IRC bots to be operated on our servers. These include Eggdrop bots and TCL scripts as well as others.
Server Abuse:
Any attempt to undermine or cause harm to a server, or customer of HollyRidge Computer & Web Services is strictly prohibited. These attempts may include (but not limited to) DOS attacks or hacking.
Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion for any reason. We don’t often do this, but normally in the event of an out of control script, failure to pay, or HollyRidge Computer & Web Services not being able to contact the site owner.
Domain Names:
– You agree to the UDRP if you register your domain through us.
Illegal Activities Strictly Prohibited!
- Illegal use:
HollyRidge Computer & Web Services’ services may not be used for illegal purposes, or in support or association of illegal activities. HollyRidge Computer & Web Services reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. If illegal content or activity is found or detected, HollyRidge Computer & Web Services reserves the right to report to law enforcement as needed, including any information that may assist them in their investigation of said activity. - Harm to minors:
Use of the HollyRidge Computer & Web Services service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography or child abuse is strictly prohibited. - Threats:
Use of the HollyRidge Computer & Web Services service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property is strictly prohibited. - Harassment:
Use of the HollyRidge Computer & Web Services service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another is strictly prohibited. - Fraudulent activity:
Use of HollyRidge Computer & Web Services service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam, such as (although not limited to) “pyramid schemes,” “ponzi schemes,” and “chain letters” is strictly prohibited. - Forgery or impersonation:
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying infrmation is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. - Unauthorized access:
Use of the HollyRidge Computer & Web Services’ service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of HollyRidge Computer & Web Services’ or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending account is subject to immediate termination. - Copyright or trademark infringement:
Use of the HollyRidge Computer & Web Services’ service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software is strictly prohibited. - Collection of personal data:
Use of the HollyRidge Computer & Web Services service to collect, or attempt to collect, personal information about third parties without their knowledge or consent is strictly prohibited. - Network disruptions and unfriendly activity:
Use of the HollyRidge Computer & Web Services service for any activity which affects the ability of other people or systems to use HollyRidge Computer & Web Services’ services or the Internet. This includes “denial of service” (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual’s computer system will result in immediate account termination. HollyRidge Computer & Web Services will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data. - Fraud:
Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it is strictly prohibited. - Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right:
Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. - Distribution of Viruses, Spyware, and other Malware:
Intentional distributions of software and/or viruses that attempt to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.Unintentional distrubution of virues are also prohibited. It is your responsiblity to ensure that your system has some form of anti-virus software running and that it is kept up to date as well as to scan all downloaded files and emails. If you are deemed to be sending out viruses of any form, your account may be deactivated or terminated to prevent the well being of others. - Any other forms of illegal activity:
Any other forms of illegal activty is also strictly prohibited.
LIMITATION OF LIABILITY:
HollyRidge Computer & Web Services shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from HollyRidge Computer & Web Services’ servers going off-line or being unavailable for any reason whatsoever. Furthermore, HollyRidge Computer & Web Services shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of HollyRidge Computer & Web Services’ servers. All damages shall be limited to the immediate termination of service.
Violations of this AUP should be referred to us through our web site.
All complaints will be investigated promptly.
Failure to follow any term or condition will be grounds for immediate account deactivation, termination, or removal without notice or refund.
DISCLAIMER:
HollyRidge Computer & Web Services cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by HollyRidge Computer & Web Services are resold. Thus, certain equipment, routing, software, and programming used by HollyRidge Computer & Web Services may not be directly owned or written by HollyRidge Computer & Web Services. Moreover, HollyRidge Computer & Web Services holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as HollyRidge Computer & Web Services sees fit.
ACCOUNT ACTIVATION:
By activating your account with HollyRidge Computer & Web Services, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer and a copy of your acceptance is forwarded along with your activation request to be maintained within your account information.
NOTICE:
If you sign up for an account and do not follow our terms. No refunds will be given. We may or may not (depending on the situation, as determined by HollyRidge Computer & Web Services) attempt to let you know by email or phone before any action is taken and you will have a chance to solve the matter.
Furthermore, HollyRidge Computer & Web Services retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification. Member’s continued use of the Service constitutes acceptance of the current terms of service as they are written.
The agreement constitutes the entire agreement between the parties hereto. The terms and conditions of this agreement shall be interpreted and enforced pursuant to the laws of Wake County, the State of North Carolina, and the United States of America.

In a few areas on our Web site, we ask you to provide information that will enable us to enhance your site visit. It is completely optional for you to participate.For example, we request information from you when you:

Our process collects the information needed for investigation, type of violation reported, several questions regarding contacting the accused (yes/no questions), explanation (text) of complaint, resolution type (text), contact information (name and e-mail), and a question asking if we can disclose your name if necessary. We keep all investigations private. If the person making the complaint offers to disclose their name, we will only do so if absolutely necessary. Under no circumstances will a person’s name or e-mail be disclosed without their prior authorization. Complaint forms are kept in our database for one-year. Backups are held indefinitely. - Feedback
We use a web-based form to provide a method of communication between the on-line community and our helpdesk. Information derived from these forms may be used in future FAQ pages or for training purposes. We will not disclose the name or e-mail address of the sender under any circumstance, nor are these fields required. Feedback forms may be removed at any time, backups are held indefinitely. - Third-Party Advertisements & Enhancements
Occasionally we invite advertisers to display their banners and/or advertisements on our site. When — and if — an advertiser requires personal information such as your IP address it will be explained here. Currently, we do not host banners that collect information.
We employ a simple stats database that collects information automatically provided by your web browser. It keeps a general log containing the date/time, IP address, and referring web-page for selected pages on our site. The information is used to help us determine if problems exist in navigation and to get an idea of where people are being referred from. - Login Page
Members of HRCWS.com must type their user name and password to gain access to certain features of our site. This information is automatically removed when the user logs off, or deletes the cookie from their system by other means. No backups are available for this form. However visitors, as well as members, may still access our site anonymously, but may not be able to use certain features, such as, although not limited to, posting messages, etc. - Cookies
Cookies are only used to keep track of log-in names and passwords. A members user name maybe automatically logged in when they revisit the site and they do not have to reenter profile information. This is to keep track of preferences and to better tailor the site to the visitor’s needs while providing the most effective service to our clients and visitors. In order to do this we collect the necessary billing data in order to process your payment. This includes information such as name, address, and credit card information. In order to perform faster and convenience of service the data recorded to perform these transactions may be recorded within the guidelines of our processor and law. If stored, this data is encrypted in database following best practice standards in accordince with law and the policies set forth by our processor. You may request at any time for us not to include or remove this data from our database. - Offline Credit Card Processing
We use our own merchant center through Square for off-line payment processing.
